《民法典》中“绿色原则”对我国法律体系的影响——以“物权法”为例
The Influence of the “Green Principle” in the “Civil Code” on China’s Legal System—Taking “Property Law” as an Example

“绿色原则”规定于《民法典》第九条，民事主体从事民事活动，应当有利于节约资源，保护环境。“绿色原则”作为民法基本原则之一，对民法中的物权具有约束效力，一切与物权有关的民事活动都需要履行节约资源，保护环境的要求。绿色原则的提出，体现了我国在民事法律领域对生态环境保护的高度重视。在物权法领域，绿色原则要求民事主体在行使物权时，积极履行节约资源、保护环境的责任，为实现可持续发展目标和生态文明建设贡献力量。在今后的社会发展过程中，绿色原则将更加凸显其重要地位，成为全体人民在民事活动中共同遵循的法律规范。
The “green principle” is stipulated in Article 9 of the Civil Code, which stipulates that Civil subjects engaged in civil activities should be conducive to saving resources and protecting the environment. As one of the basic principles of civil law, the “green principle” has a binding effect on the property rights in civil law. All civil activities related to property rights need to fulfill the requirements of saving resources and protecting the environment. The proposal of the green principle reflects the great importance China attaches to the protection of ecological environment in the field of civil law. In the field of property law, the green principle requires civil subjects to actively fulfill their responsibilities of saving resources and protecting the environment when exercising property rights, and contribute to the realization of sustainable development goals and ecological civilization construction. In the process of social development in the future, the green principle will more highlight its important position and become the legal norm that all the people follow in civil activities.
