清代刑名幕友及其司法事务之探析
An Analysis of the Criminal Adviser of the Qing Dynasty and Their Judicial Affairs

刑名幕友作为地方官员聘请的私人顾问，虽不具有官职，但却实际把持着清代地方各级衙门的司法事务，在清朝司法制度的运行过程中扮演着十分重要的角色。本文以《牧令书》等历史研究资料为依托，对刑名幕友的由来与性质进行了梳理与界定，并从案件审理的流程入手，对刑名幕友的司法职责进行了归纳与总结，以进一步探析刑名幕友在清代司法制度中的作用。
As a personal adviser hired by local officials, although they did not have official positions, they actually controlled the judicial affairs of the local praetorium at all levels in the Qing Dynasty, and played a very important role in the operation of the Qing Dynasty’s judicial system. Based on historical research materials such as the Book of Pastoral Orders, this paper sorts out and defines the origin and nature of the criminal adviser, and summarizes the judicial responsibilities of the criminal adviser from the perspective of the process of case trial, so as to further explore the role of the criminal adviser in the judicial system of the Qing Dynasty.
