室内设计常见的侵权现象及其认定标准
The Common Infringement Phenomenon of Interior Design and Its Identification Standard

我国室内设计的抄袭现象频繁发生，通过完善侵权标准，有利于保护所有权人的知识产权。文章根据室内设计的步骤分析室内设计与知识产权相关的内容，界定室内设计三种常见的侵权现象，并分析这三种现象存在的行为模式，针对不同现象提出认定标准。第一种是盗取他人图纸用于商业用途，其侵权认定标准需结合“接触 + 实质性相似”和侵权责任构成要件来认定；第二种是“搭便车”现象，行为模式是根据他人店铺进行装修，侵权认定标准是原告店铺具有知名度、店铺装潢为原告特有、被告的行为构成相同或近似使用；第三种是从平面到立体的转换，其侵权认定标准结合“接触 + 实质性相似”，根据六步认定法来认定。通过以上方法以期全面解决室内设计侵权认定标准，促进室内设计知识产权保护的新发展。
Plagiarism in interior design occurs frequently in our country. Through improving the infringement standard, it is helpful to protect the intellectual property rights of the owner. This paper analyzes the contents related to intellectual property rights according to the steps of interior design, defines three common infringement phenomena of interior design, analyzes the behavior patterns of infringement phenomena, and puts forward the identification criteria for different phenomena. The first is to steal others’ drawings for commercial use, and its infringement determination criteria should be combined with “contact + substantial similarity” and the elements of infringement liability. The second is the phenomenon of “free riding”, in which the mode of behavior is to decorate other people’s shops. The standard of infringement determination is that the plaintiff’s shop has popularity, the shop decoration is unique to the plaintiff, and the defendant’s behavior constitutes the same or similar use. The third is the conversion from plane to three-dimensional, and its infringement identification standard is combined with “contact + substantial similarity”, according to the six-step identification method. Through the above methods, we hope to solve the infringement problem of interior design comprehensively and promote the new development of intellectual property protection of interior design.
