论女性平等就业权的法律保障研究

Abstract:
在传统观念和生育政策的影响下,女性在就业中始终处于弱势地位,女性平等就业权未得到有效的保护,违背了宪法和法律中保障女性平等就业权的规定。加强对女性平等就业权的理论研究,包括社会性别平等理论、女性平等就业权,并从立法中的现行法律可行性、制定反就业歧视法、调整特殊保护的规定方面,以及司法中规范举证责任分配方面,加强对女性平等就业权的保障,推进更好地实现和维护宪法所赋予公民的平等权和人格权,推动劳动法的实施,构建和谐劳动关系。
Under the influence of traditional concepts and fertility policies, women have always been in a vulnerable position in employment, and women’s equal employment rights have not been effectively protected, which violates the provisions of the Constitution and laws to protect women’s equal employment rights. Strengthen theoretical research on women’s right to equal employment, including the theory of gender equality and women’s right to equal employment, and strengthen the protection of women’s right to equal employment from the aspects of the feasibility of existing laws in legislation, the formulation of anti-discrimination laws in employment, the adjustment of special protection provisions, and the regulation of the distribution of the burden of proof in the judiciary, we will work to better realize and safeguard citizens’ rights to equality and personality as enshrined in the Constitution, promote the implementation of the labor law, and build harmonious labor relations.
