Abstract:

海域使用权抵押是《民法典》中新增的用益物权。由于海域使用权二级流通市场发展尚不充分,使得抵押权实现中存在着各类法律问题。在海域使用权抵押法律制度运行中,易引发公私法规范适用失衡、法律规则适用冲突等问题,消解了海域使用权的变现能力以及效果。为此,需结合海域使用权抵押法律制度发展现状,对法律适用中的异变问题作出进一步回应,进而提出优化制度适用的具体变通建议,由此使制度构建适应抵押市场发展变化。
Mortgage of maritime use rights is a newly added usufructuary right in the Civil Code. Due to the insufficient development of the secondary circulation market for maritime use rights, there are various legal issues in the realization of mortgage rights. In the operation of the legal system for mortgage of maritime use rights, it is easy to cause problems such as imbalance in the application of public and private legal norms, conflicts in the application of legal rules, etc., which erode the monetization ability and effectiveness of maritime use rights. To this end, it is necessary to combine the current development status of the legal system for mortgage of sea area use rights, further respond to the issue of changes in legal application, and propose specific flexible suggestions for optimizing the application of the system, so as to make the system construction adapt to the development and changes of the mortgage market.
