网络暴力行为的法律规制完善问题研究

当前，随着互联网的发展，网络暴力成为当前危害公民个人权益以及社会公共秩序的罪魁祸首，引起了众多学者和司法实务部门的高度重视。但在实际生活中，由于当前对网络暴力行为的规制仍然有不足之处，例如：对相关部门的监管以及披露不足，公众长久以来深受“法不责众”等思想的影响，导致现阶段对我国网络暴力行为的规制仍需进一步的完善。对此，本文通过对网络暴力行为概念、特征以及法律定性的梳理，吸收采纳国外先进经验，对国内法律规制现状以及司法实践中的规制现状梳理，对法律规制、制度设立以及公众参与等实践问题进行分析和讨论，并提出自己的完善建议，以期对网络暴力规制的进一步发展起到一定的作用。
At present, with the development of the Internet, online violence has become the main culprit that endangers the rights and interests of citizens and social and public order, which has attracted the attention of many scholars and judicial practice departments. However, in practice, due to the current deficiencies in the regulation of online violence, such as insufficient supervision and disclosure of relevant departments, the public has long been deeply affected by the idea that “the law does not hold the public accountable”, resulting in the need for further improvement in the regulation of online violence in China at this stage. In this regard, this paper analyzes and discusses the current situation of legal regulation in China and in judicial practice by combing the concept, characteristics and legal characterization of online violence, absorbing and adopting advanced foreign experience, combing the current situation of domestic legal regulation and regulation in judicial practice, analyzing and discussing practical issues such as legal regulation, system establishment and public participation, and putting forward its own suggestions for improvement, in order to play a certain role in the further development of online violence regulation.
