Abstract:

21世纪以来,互联网技术快速发展,淘宝,京东等电子商务平台蓬勃兴起。电子商务凭借及时性、便捷性被社会大众所欢迎,网络购物成交量逐年上升。但是电子商务的繁荣也带来了一些问题,例如“羊毛党”利用电子商务平台标价错误牟利、电子商务平台故意发布错误价格作为虚假广告或误导性行为等。标价错误法律问题争议在于商品信息发布页性质认定不一,不同情形的标价错误问题如何具体分析找到解决办法,如何保护合同双方当事人的信赖利益。本文将主要结合《民法典》第491条及其第2款规定、《最高人民法院关于适用〈中华人民共和国民法典〉总则编若干问题的解释》19条关于重大误解的规定进行研究,寻求解决电子商务合同标价错误法律问题的办法,以期保证电子商务合同双方当事人的利益,维护交易安全。
Since the 21st century, Internet technology has rapidly developed, leading to the thriving of e-commerce platforms such as Taobao and JD.com. E-commerce has been embraced by the society due to its timeliness and convenience, resulting in a continuous rise in online transaction volume. However, the prosperity of e-commerce has also brought about certain issues, such as the exploitation of pricing errors by “scalpers” and the intentional dissemination of false or misleading advertisements by e-commerce platforms. The legal disputes surrounding pricing errors revolve around the inconsistent determination of the nature of product information pages and the specific analysis required to find solutions to different types of pricing errors and how to protect the trust interests of both parties to a contract. This paper primarily combines the provisions of Article 491 and its second paragraph of the Civil Code, as well as the 19 provisions of the Interpretation of the Supreme People’s Court on Several Issues concerning the Application of the General Principles of the Civil Code of the People’s Republic of China, to seek solutions to legal problems arising from pricing errors in e-commerce contracts. The objective is to protect the interests of both parties involved in e-commerce contracts and maintain transaction security.
