无行为则无犯罪。行为是犯罪论构建的核心要素，也是连接构成要件与责任的纽带。行为理论的研究是开展刑法学研究的基础，从19世纪末到如今，刑法学中的行为概念层出，先后出现了因果行为论、目的行为论、社会行为论、人格行为论等概念。本文旨在通过对行为理论的发展脉络进行梳理和概述，深入了解不同时期，基于不同的立场，学者们对刑法中行为的定义，以及行为在犯罪论中的体系地位。“犯罪是行为”命题必须维持。推动行为理论发展是学者们不可回避的责任。因此，对刑法学中的行为理论研究是必不可少的。
No act, no crime. Behavior is the core element of constructing the theory of crime, and it is also the link between constitutive elements and responsibility. The study of behavior theory is the basis of the study of criminal law. From the end of 19th century to the present, the concept of behavior has emerged in the criminal law of the continental law system, including the theory of causal behavior, the theory of purpose behavior, the theory of social behavior, and the theory of personality behavior. This paper aims to sort out and outline the development of the theory of behavior, and deeply understands the definition of behavior in criminal law by scholars in different periods and based on different positions, as well as the systematic status of behavior in the theory of crime. The proposition “crime is an act” must be maintained. Promoting the development of behavioral theory is the unavoidable responsibility of scholars. Therefore, it is necessary to study the behavioral theory of criminal jurisprudence.
