我国行政协议诉讼证明责任分配研究
Research on the Allocation of the Burden of Proof in China’s Administrative Agreement Litigation

传统行政诉讼单一举证规则不能解决行政协议诉讼中涉及合意性的问题，《行政协议案件若干问题的规定》结合了传统行政诉讼证明责任的内在精神和民事诉讼中关于证明责任的分配，但对于行政协议诉讼原告方和被告方的证明责任分配并未进行细化，并不能解决现行行政协议诉讼证明责任出现的问题。基于原告方的诉讼请求，依据不同类型的行政诉讼构建行政协议诉讼证明责任规则不失为是一种合理的解决路径。
The traditional administrative litigation single proof rules can not solve the administrative agreement litigation involving consensual problems, the provisions of the administrative agreement case of a number of issues combines the traditional administrative litigation of the inherent spirit of the burden of proof and civil litigation on the allocation of the burden of proof, but for the administrative agreement litigation of the plaintiff and the defendant’s side of the allocation of the burden of proof has not been refined, and can not solve the current administrative agreement litigation of the problem of the burden of proof. Based on the plaintiff's request, according to the different types of administrative litigation to construct the administrative agreement litigation burden of proof rules is not a reasonable solution path.
