论网络言论自由的法律规制
On the Legal Regulation of Free Speech

伴随着新兴网络平台的逐步崛起，公民对个人言论自由权利的使用范围和途径都发生了巨大变化。当前部分网民滥用网络平台发表不当言论而形成的网络暴力严重侵害了他人和社会的合法权益，而我国现有法律在解决因滥用网络自由而导致的各种侵权问题上还不完善，致使网民滥用网络言论行为得不到有效规制，被侵权人合法权益和被侵犯公共利益得不到有效保护。因此，为了保护公民的名誉权、隐私权等合法权利，营造良好的网络氛围，有必要利用法律这一把利剑对网络言论进行规制，进而维护社会和谐稳定与国家长治久安。本文阐述了网络言论自由法律规制的基本理论，通过借鉴国外规范网络的相关经验，分析我国今后治理网络言论的启示。
With the gradual rise of emerging online platforms, the scope and way of citizens’ use of their personal right to freedom of speech have changed greatly. The current Internet users abuse network platform published improper remarks and the formation of network violence serious violation of the legitimate rights and interests of others and society, and the existing laws in our country in the infringement problems caused by the abuse of network freedom is not perfect, the Internet abuse network speech behavior not effective regulation, the legitimate rights and interests and infringement of the public interests cannot effectively protection. Therefore, in order to protect citizens’ right of reputation, privacy and other legal rights, and create a good network atmosphere, it is necessary to use the sword of law to regulate the freedom of speech on the Internet, so as to maintain social harmony and stability and long-term peace and stability of the country. This paper expounds the basic theory of the legal regulation of the network freedom of speech, and by drawing on the relevant experience of foreign countries to regulate the network, analyzes the enlightenment of the future governance of the network freedom of speech in China.
