刑事缺席审判程序中被告人的权利保障

为打击潜逃境外的腐败分子、完善国际追逃追赃机制，刑事缺席审判制度应运而生。为弥补该制度引发的控辩关系失衡与审判不公，保障缺席被告人的合法权利，《刑事诉讼法》严格限定该制度的适用范围，并规定了被告人一系列权利，但尚存在规定过于笼统以及制度缺乏保障等困境。我国应当从明确案件适用范围、完善送达程序以保障知情权、促进有效辩护以保障辩护权、补充上诉权及异议权行使程序等方面，加强对缺席审判程序中被告人的权利保障。
In order to crack down on corrupt elements absconding abroad and improve the international fugitive and asset recovery mechanism, the criminal trial in absentia system came into being. In order to make up for the imbalance between prosecution and defense and the unfair trial caused by the system, and to protect the legitimate rights of absent defendants, the Criminal Procedure Law strictly limits the scope of application of the system and stipulates a series of rights of defendants, but there are still difficulties such as too general provisions and lack of protection of the system. Our country should strengthen the protection of the rights of the defendant in absentia trial from the aspects of clarifying the scope of application of the case, perfecting the service procedure to protect the right to know, promoting effective defense to protect the right of defense, supplementing the right of appeal and the right of objection.
