浅析网络环境下诽谤罪的司法认定

诽谤罪是侵害公民名誉权的一种犯罪类型。随着我国互联网技术的进步，该类犯罪的作案环境逐渐由现实世界转向了具有虚拟性质的网络空间。网络诽谤犯罪作为一种新类型犯罪，依托着网络技术，这类犯罪案件中的诽谤信息所呈现出的大数据化、隐蔽性、传播的迅速性等新特点，对创建良好网络舆论环境以及维持社会秩序稳定都存有极大的威胁。同时由于刑法条文未作出明确规范化的规定，因此在行为方式的认定、主观要件的明确、主体范围的确定以及情节严重的具体标准等方面都存有较大的争议。如何正确界定网络诽谤的认定标准以及如何解决认定难题，都是当前立法司法领域的重要任务。
The crime of libel is a kind of crime that infringes on citizens’ right of reputation. In the wake of the progress of network technique, the environment of such crimes has gradually shifted from the real world to the cyberspace with virtual nature. Network defamation crime is a new type of defamation crime in the network environment. Based on the network technology, the defamation information in this kind of criminal cases presents new characteristics such as big data, concealment and rapid transmission, which poses a great threat to the establishment of a good network public opinion environment and the maintenance of social order and stability. At the same time, because the provisions of the criminal law do not make clear and standardized provisions, so there are great disputes in the identification of the behavior mode, the definition of the subjective elements, the determination of the scope of the subject and the specific standards of serious circumstances. How to correctly define the standard of judicial identification of the crime of libel in the network environment and how to solve the difficult problem of judicial identification are the important tasks in the field of legislation and justice.
