应急法治下的公民知情权保障

Abstract:
公民知情权作为一项基本权利,其在权利体系中的地位日益凸显。但在我国,知情权仅在政府的相关文件中有迹可循,其并未上升到法律制度层面。我国对于公民知情权的保障,已初步取得些许成就,但瑕不掩瑜,仍然存在缺乏宪法层面法理支撑、普通法律体系尚未形成体系化以及监督机制不够成熟等问题。保障公民的知情权是完善民主法治、建设阳光政府的必然途径,也是建设现代法治国家的基本需求。因此,我国应顺应世界发展趋势,通过提升立法技术、完善普通法律体系建设以及建立健全监督机制等措施,让公民知情权的保障在实践中得到充分验证的同时,还符合我国的基本国情及时代发展的需要。
As a basic right, citizens’ right to know has become increasingly prominent in the rights system. But in China, the right to know is only found in the relevant documents of the government, and it does not rise to the level of the legal system. The protection of citizens’ right to know has made some achievements, but the defects cannot obscure the defects. There are still some problems, such as lack of constitutional legal support, lack of systemization of general legal system and immature supervision mechanism. Protecting citizens’ right to know is an inevitable way to improve democracy and rule of law and build a sunny government, and it is also a basic demand for building a modern country ruled by law. Therefore, China should conform to the world development trend, by improving the legislative technology, improving the construction of the general legal system and establishing a sound supervision mechanism, so that the protection of citizens’ right to know is fully verified in practice, but also in line with our basic national conditions and the needs of the development of The Times.
