野生动物保护法修订视野下对萤火虫法律保护探析
Legal Protection of Fireflies in the View of the Wildlife Protection Law of the People’s Republic of China

萤火虫作为野生动物的一种，在《中华人民共和国野生动物保护法》修订和《三有名录》(征求意见稿)中将其部分列入其中，加大对其的保护力度，然而，各地对萤火虫的保护和利用没有统一标准，作为药用、商用价值极高的萤火虫得不到有效的保护和合理的利用，无疑对于其生存是个重大问题。本文探析在《野生动物保护法》下通过对萤火虫制度和现实层面考量，发现目前对萤火虫的保护仍然存在很大困境，针对于此提出在野生动物保护下施行下针对萤火虫的保护对策以及完善相关司法解释和地方法规、创新管理体制方面的措施以期解决萤火虫作为野生动物的保护。
Fireflies, as a kind of wild animals, have been included in the revision of the wildlife protection law of the People’s Republic of China and the “Three Lists” (draft for consultation) to enhance their protection, however, there is no uniform standard for the protection and utilization of firefly, so it is a great problem for its survival that the firefly, which has high medicinal and commercial value, can not be effectively protected and reasonably utilized. This paper analyzes the firefly system under the “Wildlife Protection Law”. It is found that there are still significant difficulties in protecting fire-flies at present. In response to this, measures are proposed to implement protection measures for fireflies under wildlife protection, as well as to improve relevant judicial interpretations, local regulations, and innovative management systems to solve the firefly protection as a wild animal.
