未成年人检察社会支持体系研究
Research on Social Support System for Juvenile Procuratorial Work

少年司法中强调对未成年人的综合保护。未成年人司法的发展和实施需要一个健全的社会支持体系。然而，未成年人社会支持体系由于出现时间较晚，其发展目前还处于初级阶段，无法全面满足对未成年人的综合保护需求。对于未成年检察支持体系的研究有利于促进我国少年司法专业化、职业化司法格局的构建，实现对于未成年人的权益保障。本文首先对于未成年检察社会支持体系的概念、建构情况进行明晰，厘清该体系的功能与地位。其次，检视了我国未检支持体系的现实困境，其客观上主要存在管理权限不明、权益保障冲突等问题。最后，提出了自己的完善思考。在未成年检察社会支持体系中，检察机关是主导主体，完善未检体系研究必须要明晰检察机关在未成年人权益保护中的限度，推动未检非诉工作规范化，此外，还需提升未检的专业化水平，使得未成年人检察社会支持体系真正发挥实效。
The comprehensive protection of minors is emphasized in juvenile justice. The development and implementation of juvenile justice needs a sound social support system. However, due to the late appearance of the social support system for minors, its development is still in the initial stage, and it cannot fully meet the comprehensive protection needs of minors. The research on the juvenile procuratorial support system is conducive to promoting the construction of professional judicial structure of juvenile justice in our country, and realizing the protection of the rights and interests of minors. This paper first clarifies the concept and construction of the juvenile procuratorial social support system, and clarifies the function and status of the system. Secondly, it examines the realistic dilemma of uninspected support system in our country. Objectively, it mainly exists such problems as unclear management authority and conflict of rights and interests protection. Finally, it puts forward their own perfect thinking. In the juvenile procuratorial social support system, the procuratorial organ is the leading subject. To improve the study of the undetected system, it is necessary to clarify the limits of the procuratorial organ in the protection of the rights and interests of minors, and promote the standardization of the work of undetected and non-prosecution. In addition, the professional level of undetected should be improved to make the social support system for juvenile procuratorial work truly effective.
