The Responsibility of Internet Service Providers in the New Media Era—From the Perspective of Online Video Copyright Infringement

近年来，互联网视频著作权侵权问题屡见不鲜。关于网络服务提供者的责任认定问题，既是理论界的争论焦点，也是实务界的判决要点。中国法律虽然规定了网络服务提供者的注意义务，但并未明文规定其主动审查义务，而对其通知审核义务与事后防范义务的规定也较为模糊。为促进网络视频产业的良性发展，需要通过研发并运用过滤技术、明确合理使用制度、强调比例原则的方式，来明确网络服务提供者的注意义务、通知审核义务以及事后防范义务。
In recent years, the problem of Internet video copyright infringement is commonplace. Regarding the responsibility of network service providers, it is both the focus of the theoretical debate and the key point of judgment in practice. Although China’s law stipulates the duty of care of network service providers, it does not expressly provide for their active review obligation, and the provisions of their notification and audit obligation and after-the-fact prevention obligation are also relatively vague. In order to promote the benign development of the online video industry, it is necessary to clarify the duty of care, the duty of notification and review, and the duty of prevention of network service providers through the research and development and application of filtering technology, the clarification of the fair use system, and the emphasis on the principle of proportionality.
