数字空间中不正当竞争行为的法律规制
Legal Regulation of Acts of Unfair Competition in the Digital Space

随着互联网的兴起和数字经济的蓬勃发展，数据已然成为数字时代最为重要的资源要素。然而，不正当竞争行为也在数字空间中不断增加。文章从数字空间中不正当竞争行为的背景出发，探讨了数字空间中不正当竞争行为的特点。针对当下我国存在的现状，认为应通过法律规制来纠正数字空间不正当竞争行为的现象，从明确网络不正当竞争行为的表现形式、健全行政执法监管机制以及完善网络反不正当竞争司法机制的三个方面提出建议。最后指出只有构建符合数字经济发展特征的不正当竞争法律规制体系，才能为数字空间的发展营造一个公平自由的数据要素市场环境。
With the rise of the Internet and the vigorous development of the digital economy, data has become the most important resource element in the digital age. However, unfair competition behavior is also constantly increasing in the digital space. Starting from the background of unfair competition behavior in digital space, the article explores the characteristics of unfair competition behavior in digital space. In response to the current situation in China, it is believed that the phenomenon of unfair competition in digital space should be corrected through legal regulations. Suggestions are proposed from three aspects: clarifying the manifestations of online unfair competition, improving administrative law enforcement and supervision mechanisms, and improving the judicial mechanism for online anti unfair competition. Finally, it is pointed out that only by establishing a legal regulatory system for unfair competition that conforms to the characteristics of digital economy development can a fair and free market environment for data elements be created for the development of digital space.
