陪审制度中人民陪审员职权范围调整的路径分析

在建设中国特色社会主义法治国家的大背景下，陪审制度重新得到重视。新形势下，陪审制度仍有其制度价值。《人民陪审员法》及其司法解释对其进行了改革，突出了民主色彩，重构了职权配置，形成了“混合模式”，引入了新机制，主要目的是使其发挥应有作用，提高司法公信力。但改革力度不够，职权配置方面存在三人庭与七人庭“异权”的问题，陪审制度的配套措施也需要得到完善。在总体的政策指导下统一陪审员职权，完善配套机制，并发挥审前制度的作用。
In the context of building a socialist country under the rule of law with Chinese characteristics, the jury system has been given renewed attention. Under the new situation, the jury system still has its institutional value. The People’s Jurors Law and its judicial interpretation have reformed it, high-lighted the colour of democracy, reconstructed the allocation of functions and powers, formed a “mixed model”, and introduced a new mechanism. The main purpose is to make it play its due role and improve judicial credibility. However, the reform is not strong enough. There is a problem of “disative powers” between the three-person court and the seven-person court in terms of authority allocation, and the supporting measures of the jury system also need to be improved. Under the overall policy guidance, we unify the functions and powers of jurors, improve the supporting mechanism, and play the role of the pre-trial system.
