大数据时代网络著作权保护的法律问题研究
Research on Legal Issues of Network Copyright Protection in the Era of Big Data

21世纪以来，数字信息技术不断迭代更新，数字文化产业领域因此也不断成长。可是当前国家立法存在滞后，同时网络著作权问题还涉及多个国家和地区，需要进行跨法域间的合作和协调，这给传统著作权保护模式带来了巨大的挑战。本文围绕著作权法在大数据时代受到的冲击，讨论大数据时代网络著作权保护面临相关网络著作权法律保护的滞后、网络著作权保护边界难以明确、确定侵权主体困难等法律困境，对此提出完善网络著作权立法体系、明确侵权责任、立法应具备预测性来加强网络著作权立法的建议，同时，将其纳入到《国际战略学》和《政治学研究方法》等政治学一流专业建设的教学之中进行研究和探讨，以便更好培育学生在相关领域的多元专业素养。
Since the 21st century, digital information technology has been iterated and updated continuously, and the field of digital culture industry has been growing continuously. However, there is a lag in the current national legislative activities, and the issue of Internet copyright also involves many countries and regions, requiring cross-jurisdictional cooperation and coordination, which brings great challenges to the traditional copyright protection mode. Legal norms in line with the requirements of the era of big data are the guarantee for maintaining normal and compliant network communication order. This paper will discuss the legal dilemmas of network copyright protection in the era of big data, such as the lag of relevant network copyright legal protection, the difficulty of defining the boundary of network copyright protection and the difficulty of determining the infringing subject, based on the impact of copyright law in the era of big data. In order to improve the governance ability of intellectual property, the author puts forward some suggestions to improve the legislative system of Internet copyright, clarify the liability of infringement and make legislation predictive.
