乡村生态环境保护地方立法困境及对策探究
Research on the Dilemma and Countermeasures of Local Legislation of Rural Ecological Environmental Protection

《乡村振兴促进法》全面实施背景下，探讨乡村生态环境保护地方立法面临“地方性”意识不足、立法质效不高、“形式主义”与“拿来主义”现象、立法科学性和专业性不强、欠缺体系性和针对性等现实困境与问题挑战。从坚持科学立法理念、突出地方特色立法、提高立法主动性与创新性、地方有关立法体系化和具象化等方面研究提出完善我国乡村生态环境保护地方立法的逻辑进路与建议，期望从乡村生态环境地方立法视角出发，为有效解决乡村生态环境问题、推进乡村生态振兴提供帮助。
Under the background of the full implementation of the “Rural Revitalization Promotion Law”, the local legislation of rural ecological and environmental protection is faced with the lack of “local” awareness, insufficient legislative quality and effectiveness, the existence of “formalism” and “bringing” phenomena, and the scientific and professional nature of legislation. It is not strong, lacks systematization and pertinence and other practical difficulties. In response to these problems and challenges, this paper puts forward the logical approach to the current local legislation of rural ecological environment protection in my country from the following aspects: Insisting on scientific legislative concepts, highlighting local characteristics of legislation, improving legislative initiative and innovation, and systematizing and concretizing relevant local legislation. It is hoped that from the perspective of local legislation on rural ecological environment, it will provide help for effectively solving rural ecological environment problems and promoting rural ecological revitalization.
