袭警罪的司法适用问题研究
A Study on the Judicial Application of the Crime of Attacking a Police Officer

刑法修正案十一增加了袭警罪的罪名，该罪从设立之后的案件数量不断攀升，案件中的行为人袭警的情形也有轻有重千差万别，虽然对于袭警行为有了有力的打击，但对于该罪的司法适用不统一以及存在扩张的趋势成为了学界热烈探讨的话题。本文拟从本罪的构成要件和保护法益出发，将本罪的构成要件进行深层次的理解和分析，探讨其在司法说过程中的标准，从而希望对本罪形成统一的袭警罪认定标准，以求在司法实践中避免出现同案不同判的情况，这是本文研究的主要目的，届时将从该罪的各种要件进行分析，以求将该罪的认定标准化。
The Eleventh Amendment to the Criminal Law has added the charge of assaulting police officers. The number of cases of this crime has been continuously increasing since its establishment, and the situation of the perpetrator assaulting police officers in the cases varies greatly. Although it has effectively dealt a blow to the behavior of assaulting police officers, the uneven judicial application and the trend of expansion of this crime have become a hot topic of discussion in the academic community. This article intends to conduct a deep understanding and analysis of the constituent elements of this crime and the protection of legal interests, exploring its standards in the judicial process, in order to form a unified standard for the determination of the crime of assaulting police officers, in order to avoid the occurrence of different judgments in the same case in judicial practice. This is the main purpose of this article’s research. At that time, various elements of this crime will be analyzed, in order to standardize the determination of this crime.
