离婚家务劳动补偿制度适用研究

家务劳动补偿制度作为离婚救济性制度组成部分之一，从法律层面肯定了家务劳动的经济价值，该制度随着《民法典》的出台被激活，实践中出现了不少案例。但该制度缺乏详细的适用规定，使其在适用时意义大打折扣。应明确补偿金额的考量要素，提高补偿数额；多元化补偿形式及明晰责任财产范围；扩大家务劳动补偿权请求权行使的时间；适度放宽举证责任，引入“优势证据”规则以使该制度更为完善。
As one of the components of the divorce relief system, the housework compensation system affirms the economic value of housework from the legal level. With the introduction of the Civil Code, the system has been activated, and there have been many cases in practice. However, the lack of detailed applicable regulations makes it less meaningful when applied. The consideration factor of compensation amount should be made clear and the compensation amount should be increased. We should diversify compensation forms and clear scope of liability property, enlarge the time for exercising the right to claim compensation for housework, moderately relax the burden of proof, and introduce “prepondious evidence” rule to make the system more perfect.
