我国残疾儿童义务教育权的法律保护
Legal Protection of Compulsory Education Right of Disabled Children in Our Country

我国宪法赋予公民接受教育的基本权利，义务教育权是受教育权的基本内容。残疾儿童作为社会中的特殊群体，受到《宪法》的平等保护。在残疾儿童的基本权利中，义务教育阶段的受教育权是社会需要迫切关注的权利，虽然残疾儿童教育在我国已经有了较为迅速的发展，但与正常儿童相比，残疾儿童教育仍然面临着入学率低、辍学率高等困境。回望我国对于残疾儿童教育的保障，法律保护方面的不足尤为明显，因此，本文主要对残疾儿童义务教育权的法律保护展开探讨。
China’s Constitution gives citizens the basic right to receive education, and the right to compulsory education is the basic content of the right to education. Children with disabilities, as a special group in society, enjoy equal protection under the Constitution. Among the basic rights of children with disabilities, the right to education in the compulsory education stage is a right that requires urgent attention in society, although the education of children with disabilities has developed relatively rapidly in China, but compared with normal children, the education of children with disabilities still faces the dilemma of low enrollment rate and high dropout rate. Looking back at the protection of education for children with disabilities in China, the lack of legal protection is particularly obvious, so this article mainly discusses the legal protection of the right to education enjoyed by children with disabilities in the compulsory stage.
