影视类作品二次剪辑短视频著作权侵权问题研究

影视作品的二次剪辑创作是随着短视频平台兴起而产生的一个新兴的创作方式，创作者通过对他人享有著作权的影视作品通过添加背景音乐、插入二次创作者的原声解说等方式进行二次加工，从而得到一个新的作品。二次剪辑的短视频在一定程度上促进了原影视作品的繁荣发展的同时，也使得二次剪辑的作品超越合理的界限，侵犯原影视作品的著作权，严重者甚至构成刑事犯罪等。但是现行的法律对二次剪辑类短视频的侵权问题却没有详细规定，存在着二次剪辑短视频作品的法律性质认定难、二次创作边界模糊、短视频平台不作为等一系列问题，给二次剪辑短视频著作权的侵权认定造成一定阻碍。本文通过分析二次剪辑类短视频侵犯著作权的现状，结合相关法律规定，进一步探讨影视类作品二次剪辑的著作权侵权问题。
The creation of secondary editing of film and television works is a new creation method that comes into being with the rise of short video platforms. The creator can obtain a new work by adding background music and inserting the original narration of the secondary creator through secondary processing of the film and television works that are copyrighted by others. To a certain extent, the short videos of secondary editing promote the prosperity and development of the original film and television works, but also make the secondary editing works go beyond the reasonable limits, infringe the copyright of the original film and television works, and even constitute criminal crimes. However, the current law has no detailed regulations on the infringement of short videos of secondary clips. There are a series of problems, such as the difficulty in identifying the legal nature of the second clip short video works, the ambiguity of the boundary of the second creation, and the inaction of the short video platform, which cause certain obstacles to the identification of the copyright infringement of the second clip short video. By analyzing the current situation of copyright infringement of short videos of secondary clips and combining with relevant laws and regulations, this paper further discusses the copyright infringement of secondary clips of film and television works.
