数字政府建设政企合作模式的追责机制研究

在数字政府建设背景下，因数字技术与行政权力的融合与运用产生了新型的算法侵害和数据安全风险，而由于数字政府治理模式中多元主体并存、公私利益对立、数字技术障碍难以准确定位责任主体，存在“数字避责”现象以及事后追责成效式微的追责困境。为进一步发挥追责机制的作用，应当以权责统一原则与权利义务相一致原则为理论基础，明确政府和企业之间的权利义务，正确划分政府和企业的内外部责任；明确数字政府建设中政企合作模式的追责机制，加强数字政府建设的法治化。
In the context of the construction of digital government, the integration of digital technology and administrative power has produced new algorithm infringement and data security risks. However, due to the coexistence of multiple subjects, the opposition between public and private interests and the obstacles of digital technology, it is difficult to accurately locate the responsible subjects, and there is a phenomenon of “digital evasion” and the dilemma of accountability after the event. In order to define the responsibilities of enterprises and the government, it should be based on the principle of unity of power and responsibility and the principle of consistency of rights and obligations. On the one hand, it clarifies the rights and obligations between the government and enterprises so that correctly divide the responsibilities of the government and enterprises. On the other hand, it clarifies the system of accountability of the government-enterprise cooperation in the construction of digital government, and strengthens the rule of law.
