论我国宪法中的公民养老权及其法律保护
On the Citizen’s Pension Right in China’s Constitution and Its Legal Protection

中国正在步入老龄化社会，养老问题将会成为一个很重要的社会问题。从宪法学的意义上来看，国家承担养老责任不仅有对公民个人的“生存照顾”、“基本权利的保护义务”作为理论基础，更有宪法规范上的直接依据。我国的现代化建设也内涵地要求政府积极推行保障公民社会权实现的性能，确保公民的社会保障权在政府的积极作为下也能够得到相应的保障。在养老问题上，就体现为公民在年老之时，国家为其提供在生活上切实可行的保障。
China is entering an aging society, and the pension problem will become a very important social problem. From the perspective of constitutional law, the state’s responsibility for the elderly not only has the theoretical basis of “survival care” and “protection obligation of basic rights”, but also has the direct basis of constitutional norms. China’s modernization also requires the government to actively perform the function of safeguarding the right of civil society, to ensure that citizens’ social security rights can be guaranteed under the active action of the government. In the issue of pension, it is reflected that when citizens are old, the state provides practical security in life.
