在大数据时代，网络犯罪相比以往也越加复杂和多样，这给刑事案件的侦察带来了很大的挑战。在这其中，电子数据的取证问题就成了侦破案件的关键点，但是电子数据相对于传统的数据有很大的差异，存在着许多待解决的新问题。尤其是电子数据取证不仅涉及到法学领域，也涉及到电子计算机领域，有着极强的专业性，这就加大了刑事案件过程中电子数据取证的难度。但面对当下网络电子犯罪激增现状，必须解决电子数据取证产生的实践难题和矛盾问题。有鉴于此，本文将通过对电子数据相关概念的界定、电子数据取证的现状去探究电子数据取证的实践困境，从而提出相应的完善建议，更好的用法律去规制存在的问题。
In the era of big data, cyber crimes are becoming more complex and diverse than ever before, which brings great challenges to the investigation of criminal cases. Among them, the problem of electronic data forensics has become the key point to solve the case, but the electronic data are very different from the traditional data, there are many new problems to be solved. In particular, electronic data forensics not only involve the field of law, but also involve the computer neighborhood, which has great professionalism, which increases the difficulty of electronic data forensics in the course of criminal cases. However, facing the current situation of the surge of network electronic crime, we must solve the practical problems and contradictions caused by electronic data forensics. In view of this, this paper will explore the practical dilemma of electronic data forensics through the definition of relevant concepts of electronic data and the status quo of electronic data forensics, so as to put forward corresponding improvement suggestions and better regulate the existing problems by law.
