虐待动物行为入刑问题研究
Research on the Criminalization of Animal Cruelty

近年来，我国频繁被曝光出一些血腥的虐待动物事件，并且虐待动物的手法也更加残暴。这种恶劣的社会现象引起了公众的愤怒和不满，越来越多的动物保护者呼吁我国尽快出台“反虐待动物法”、“动物保护法”，或是引用国外现成的法律体系。然而，一套成熟法律的出台，不仅需要循序渐进的过程，更需要极其严谨全面的程序要件。本文综合分析了国内外虐待动物入刑的政策现状、阐述了相关概念界定，认为在我国制定“反虐待动物法”具有一定的可行性，制定“反虐待动物法”不仅能使公民树立正确的生命观，提高公民道德素质，进而促进社会和谐，而且也有助于中国国际地位的提升。
In recent years, China has been frequently exposed some bloody animal abuse incidents, and the methods of animal abuse have become more brutal. This bad social phenomenon has aroused public anger and dissatisfaction, and more and more animal protectors are calling for the introduction of “anti-animal cruelty law” and “animal protection law” as soon as possible, or the introduction of foreign ready-made legal system. However, the introduction of a set of mature laws not only requires a gradual process, but also requires extremely rigorous and comprehensive procedural elements. This paper comprehensively analyses the current situation of the policy of criminalisation of animal cruelty at home and abroad, explains the definition of the relevant concepts, and argues that it is feasible to formulate an “anti-animal cruelty law” in our country, and that the enactment of an “anti-animal cruelty law” not only enables the citizens to establish a correct view of life, but also improves the moral quality of the citizens, which in turn promotes the development of the public. The enactment of an “anti-animal cruelty law” will not only enable citizens to establish a correct outlook on life, but also improve the moral quality of citizens and promote social harmony, and will also help to improve China’s international status.
