Abstract:

法学作为一门特殊的社会科学,存在知识点多、概念抽象、专业性强等特点,在传统教学中学生普遍存在基础理论理解不透彻,法律思维欠缺和处理案件能力有限等问题,因此,重视培养法本学生的法律能力尤为重要。本文试图以民法课程思政教学改革为契机,通过民法课程与法治社会建设的关系及作用机理研究,将民法课程置于法治社会建设、社会治理现代化的新时代背景中,探求民法课程思政建设的内在逻辑,并从教学改革实践中总结法本学生法律能力培养的有效路径。在本次教学改革尝试实践中,综合运用案例分析、民事习惯调查和模拟法庭开庭演练等特色教学方法,打造理论课堂和实践课堂两个课堂,从知识、能力和素养三个层次全面进行高素质应用型法治人才培养,探索课程育人新途径,践行习近平法治思想,推动法治社会建设。
As a special social science, law has the characteristics of many knowledge points, abstract concepts, and strong professionalism. In traditional teaching, students generally have problems such as incomplete understanding of basic theories, lack of legal thinking, and limited ability to deal with cases. Therefore, it is particularly important to attach importance to training the legal ability of law undergraduate students. This paper attempts to take the reform of ideological and political education of civil law curriculum as an opportunity, through the research on the relationship and mechanism between civil law curriculum and the construction of a society ruled by law, put the civil law curriculum in the new era background of the construction of a society ruled by law and the mod-ernization of social governance, explore the internal logic of ideological and political education of civil law curriculum, and summarize the effective path of legal ability cultivation of law undergraduate students from the practice of teaching reform. In the trial practice of this teaching reform, we will comprehensively use case analysis, civil custom investigation, simulated court practice and other characteristic teaching methods to create two classes of theory class and practice class, com-prehensively cultivate high-quality applied law talents from three levels of knowledge, ability and quality, explore new ways of curriculum education, practice the Xi Jinping’s Thought on the Rule of Law, and promote the construction of a society under the rule of law.
