构建我国刑事诉讼管辖权异议制度之探讨

管辖权异议制度不管是在大陆法系或是英美法系的刑事诉讼中都是一种十分重要的制度，其对于公权制约、当事人诉讼权利的保障以及提高刑事诉讼效益方面起着非同寻常的作用。但是我国的《刑事诉讼法》没有赋予当事人该项权利，随着我国法治进程的深入发展、公民法律素养的提高和对权利保护的深入理解，理论界关于构建刑事管辖权异议制度的呼声越来越高。由于我国目前还没有相应的立法，在我国司法实践中，对于不同的当事人提出的管辖权异议问题，其应对的方式也各不相同。所以，我们从理论上来探讨构建具有我国特色的管辖权异议制度也会有利于实践的发展。
The jurisdictional objection system is a very important system in both civil law and common law criminal proceedings, and it plays an extraordinary role in restricting public power, protecting the procedural rights of parties and improving the efficiency of criminal proceedings. However, China’s Criminal Procedure Law does not grant parties this right, and with the in-depth development of China’s rule of law process, the improvement of citizens’ legal literacy and the in-depth understanding of rights protection, the voice of theoretical circles on the establishment of a criminal jurisdiction objection system is getting higher and higher. Since China currently does not have corresponding legislation, in China’s judicial practice, the ways to deal with jurisdictional objections raised by different parties are also different. Therefore, our theoretical discussion on the construction of a jurisdictional objection system with Chinese characteristics will also be conducive to the development of practice.
