论我国独立保函欺诈例外规则的适用问题

在经济全球化的背景下，传统的担保形式已经很难满足交易双方当事人的利益需求，独立保函制度便得以在中国广泛应用，这无疑在很大程度上促进了我国金融贸易领域的发展。区别于其他保证形式，独立保函其与基础交易相互分离的这一特点在赋予当时交易极高效率的同时，也迫使担保人承受着受益人欺诈索款的风险。独立保函欺诈例外规则便应运而生，对欺诈情形的认定是当下我国司法机关面临的重大挑战，既要保证保函的独立性，又要确保该独立性不为交易当事人滥用，相较于国际规则以及其他国家的相关法律，我国的相关规则以及实际运用还有很大的进步和完善空间。
In the context of economic globalization, the traditional form of guarantee has been difficult to meet the interests of both parties of the transaction needs, and the independent guarantee system will be widely used in China, which undoubtedly to a large extent promotes the development of China’s financial and trade field. Different from other forms of guarantee, independent guarantee is separated from the underlying transaction, which not only endures the transaction with high efficiency, but also forces the guarantor to bear the risk of beneficiary’s fraud. Independent guarantee of fraud exception rule then arises at the historic moment; the fraud case is the major challenge confronted by the judicial organs in our country, both to ensure the independence of the letter of guarantee, and ensure that the independence is not for trading the abuse of the parties; compared with the international rules and laws in other countries, our country’s relevant rules and actual application still have great progress and improvement space.
