论想象竞合与法条竞合在刑事司法活动中的区分与运用
On the Distinction and Application of Imagination Concurrence and Law Concurrence in Criminal Judicial Activities

法条竞合和想象竞合一直都是刑法学罪数形态中比较难以区分的两个理论，尤其在刑事司法活动中涉及到一个犯罪行为同时触犯刑法中的两个罪名时，是按照想象竞合择一重罪论处，还是法条竞合特别罪名优先于普通罪名，不同的主张会导致案件出现不同的结果。本文提出“二阶层区分法”，能够更有效地区分想象竞合与法条竞合，做到罪责刑相适应，同时结合司法案例将该理论融入到犯罪形态、情节加重犯和结果加重犯等一些复杂情况中，希望能够更好地实现打击犯罪与保障人权的兼顾。
Article conjunctivism and imaginary conjunctivism have always been two theories that are diffi-cult to distinguish in the number of criminal law crimes. Especially, when a criminal act is involved in criminal justice activities, whether to choose a felony according to imaginary conjunctivism or whether the special charge of article conjunctivism takes precedence over the ordinary charge, different opinions will lead to different results in the case. This paper puts forward the “two-class division law”, which can more effectively distinguish the imagination conjunctive cooperation and the law conjunctive cooperation, so as to achieve the adaptation of crime, responsibility and punishment. At the same time, combining with judicial cases, this theory is integrated into some complex situations such as crime form, circumstance aggravated crime and consequence aggravated crime, hoping to better realize the balance between fighting crime and protecting human rights.
