个人信息倾斜性保护的挑战与应对
Challenges and Solutions to the Protection of Personal Information Inclination

随着人工智能的发展和大数据时代的到来，一些特定行业或领域的不平等关系日益凸显。《个人信息保护法》倾斜保护了个人信息保护领域里由于信息能力差异造成的不平等关系中的弱势信息主体，是研究倾斜保护型法律的重要指引，也是人权保障的集中体现，具有独特的研究意义。文章从个人信息倾斜保护存在的正当性与合理性、特定行业或领域发展带来的个人信息保护的历史必然性以及个人信息在社会上的流通属性论述了个人信息倾斜保护的理论基础，提出了当前倾斜保护中信息处理者、用户和政府面临的挑战，并以此为基础，给出了相应的建议。
With the development of artificial intelligence and the arrival of the era of big data, the unequal relationship between some specific industries or fields has become increasingly prominent. The Personal Information Protection Law gives preferential protection to the vulnerable information subjects in the unequal relationship caused by the difference in information ability in the field of personal information protection. It is an important guide for the study of the law of preferential protection, and also a concentrated embodiment of human rights protection, with unique research significance. This paper discusses the theoretical basis of slanted protection of personal information from the legitimacy and rationality of the existence of slanted protection of personal information, the historical necessity of personal information protection brought by the development of specific industries or fields and the circulation attribute of personal information in society, and puts forward the challenges faced by information processors, users and governments in the current slanted protection, and on this basis, the corresponding suggestions are given.
