对意定监护中被监护人保护的研究
A Study on the Protection of the Defendant in Intentional Guardianship

在意定监护制度中，被监护人可以根据个人的意志选定监护人，与传统监护相比，减少了道德常理的束缚，更容易诱发监护人的道德风险，使被监护人的权益得不到保证。《民法典》规定了意定监护的内容，该条承继了《老年人权益保障法》的规定，将原本的适用老年人的权益范围扩展到成年人。同时，《民法典》第36条规定了意定监护监督制度，配套意定监护的拓展，虽然保证了部分被监护人的需求，但是仍然存在问题。本文主要通过对于意定监护中被监护人保护的困境，借鉴国外的立法经验提出以立法为基础，公证和信托相结合，加强司法介入和监督的建议。
In the intentional guardianship system, the defendant can choose the guardian according to the individual’s will. Compared with the traditional guardianship, it reduces the constraint of moral common sense and is more likely to induce the moral hazard of the guardian, so that the rights and interests of the guardian can not be guaranteed. The Civil Code defines the content of intentional guardianship, which inherits the provisions of the Law on the Protection of the Rights and Interests of the Elderly and extends the scope of the rights and interests of the elderly to adults. At the same time, Article 36 of the Civil Code stipulates the intentional guardianship supervision system, supporting the ex-pansion of the intentional guardianship. Although the needs of some of the defendants are guaran-teed, there are still problems. Based on the dilemma of defendant protection in the intentional guardianship, this paper draws on foreign legislative experience and puts forward some sugges-tions on strengthening judicial intervention and supervision on the basis of legislation, combining notary and trust.
