Abstract:

近年来,网络技术的发展越来越快,淘宝、京东等线上购物平台打破时间和空间的限制成为了消费者购物的主阵地,消费者不用到线下商店就能买到诸如衣服、裤子、鞋子等自己心仪的商品,具有省时省力、节约成本等特点。但是淘宝、天猫等线上购物平台给人们的生活带来便利的同时,发货迟缓、质量瑕疵问题、虚假促销等侵犯消费者权利的现象也频频出现。在线上购物这种特殊的购物环境中,商家掌握的信息明显远远大于消费者,这就导致了消费者在网络购物中明显是处于弱势地位,因此其合法权利的保护就显得非常的重要。本文首先对线上购物消费者权益保护中存在的知情权难以实现等问题进行了分析,随后基于以上分析,提出了完善消费者权益保护的建议。
In recent years, the rapid development of network technology, Taobao, Jingdong and other online shopping platforms to break the constraints of time and space has become the main position of consumer shopping, consumers do not have to go to offline stores to buy their favorite goods such as clothes, pants, shoes, etc., with time and effort, cost savings and other characteristics. However, while online shopping platforms such as Taobao and Jingdong have brought convenience to people’s lives, delayed delivery, quality defects, false promotions and other violations of consumer rights have also emerged frequently. In the special shopping environment of online shopping, the information held by the merchants is obviously far greater than that of consumers, which leads to the fact that consumers are obviously in a vulnerable position in online shopping, so the protection of their legal rights is very important. In this paper, we first analyze the problems that exist in the protection of consumers’ rights and interests in online shopping, such as the difficulty of realizing the right to information, and then propose suggestions to improve the protection of consumers’ rights and interests based on the above analysis.
