人口老龄化背景下我国老年人社会参与权问题研究

随着我国老龄化程度的不断加重，老年人社会参与权的重要性更加凸显，其中涉及政治参与、经济参与、公益参与以及组织参与等不同领域。但目前我国老年人的社会参与权缺乏系统性法律制度的支撑、老年人在社会参与中也遭受着年龄歧视与社会排斥，同时权利救济路径也面临缺失。对此，可以通过完善老年人社会参与权立法、执法的保障机制，完善老年人社会参与权的救济路径，使老年人在社会参与中更好的实现自己的价值。
With the increasing degree of aging in our country, the importance of social participation rights of the elderly is more prominent, including political participation, economic participation, public interest participation and organizational participation, which are deeply embedded in the social structure. But at present, the social participation rights of the elderly in our country face the lack of systematic legal system support, the elderly in social participation are also suffering age discrimination and social exclusion, the lack of rights relief path, etc. In this regard, we can improve the guarantee mechanism of legislation and law enforcement of the social participation right of the elderly, and at the same time improve the relief path of the social participation right of the elderly, so that the elderly can better realize their own value in social participation.
