汽车产业标准必要专利许可费用研究

Abstract:
为了明确汽车产业标准必要专利机制的运行状况，首先采用统计分析法，以22份标准化组织披露的专利文件为材料，确定了该领域内专利许可纠纷的发生范围，阐述了已有研究成果与前述范围的不适应性，进而提出通过总结司法案例、商业惯例、法律框架，阐明了现阶段上述范围内许可费用所受到的具体法律限制，最后以推动产业发展、规避风险为出发点，在这一法律限制框架内为我国处理有关问题提出了应对建议。
In order to clarify the operation status of the standard essential patent mechanism for automobile industry standards, firstly, using the statistical analysis method and 22 patent documents disclosed by standardization organizations as materials, the scope of patent licensing conflict disputes in this field was determined, and the incompatibility between the existing research results and the aforementioned scope was described. Secondly, by summarizing judicial cases, business practices and legal frameworks, it clarifies the specific legal restrictions on the license fees within the above scope at this stage, and finally puts forward suggestions for China to deal with relevant issues within the framework of this legal restriction, starting from promoting industrial development and avoiding risks.
