解释论视角下《民法典》中居住权制度理论与实践研究
Study on the Theory and Practice of Residence Right System in the Civil Code from the Perspective of Interpretation

《民法典》物权编新增了居住权制度，并在第十四章以专章的形式对居住权予以了新规定。这一制度的新鲜出炉也带来了学者对其价值功能、规范目的和制度不足提出了分析论证。学者从各个方面提出《民法典》居住权制度现有法律之缺憾，并因此也提出一些相关的完善建议。鉴于《民法典》已经出台的背景，再讨论立法的完善不是一条适宜和可操作性的路径，因而意义不大。因此，本文主要从解释论视角，分析既有居住权入典之后一系列法律解释的适用问题。从解释论视角下应对居住权在运行过程的系列问题，增强司法裁判的能动性并发挥指导性案例的法治引领作用，在对居住权司法裁判规则的逻辑理路的同时，在现有法律框架下，为居住权创设一个更好的发展空间和法律环境，也为“老有所依”寻求更为便捷的保障方式。
“Civil Code” the real right of the new system of residence, and in the fourteenth chapter in the form of a special chapter to the right of residence to give a new regulation. The new introduction of this system has brought scholars to analyze and demonstrate its value function, normative purpose and institutional deficiencies. Scholars put forward the defects of the existing law of residence right system in Civil Code from various aspects, and put forward some relevant suggestions for improvement. In view of the background of the Civil Code, it is not a suitable and operable path to discuss the perfection of legislation, so it is of little significance. Therefore, this paper mainly analyzes the application of a series of legal interpretations of the existing residence right from the perspective of interpretative theory. From the perspective of interpretation, we should deal with a series of problems in the operation process of the right of residence, enhance the initiative of judicial judgment and give play to the guiding role of the rule of law of guiding cases, and create a better development space and legal environment for the right of residence under the existing legal framework, as well as seek a more convenient way of protection for the “elderly have somewhere to live”.
