生育权保护是对公民基本权利保障的应有之义，对该问题的探讨具有尊重和保障人权的重要意义，当前婚姻关系中的生育权纠纷案件数量日益增多，婚姻关系内部的生育权保障问题亟待研究。首先考察现有法律规制与生育权司法实践的概况，并对婚姻家庭领域的生育利益纠纷案件予以类型化分析；其次讨论婚姻关系内部生育权存在的必要性与理论依据；最后为该类生育权救济方式提供相应建议并阐述其行使方式，包括侵权损害赔偿、撤销婚姻关系、起诉离婚三种救济途径。
The protection of reproductive rights is the proper meaning of the protection of citizens’ basic rights, and the discussion of this issue is of great significance to respect and protect human rights. At present, the number of reproductive rights disputes in marriage relations is increasing, and the protection of reproductive rights within marriage relations needs to be studied urgently. Firstly, it examines the general situation of existing legal regulation and judicial practice of reproductive rights, and analyzes the reproductive interest disputes in the field of marriage and family; then discusses the necessity and theoretical basis of reproductive rights within marriage relationship; finally provides the relief suggestions of reproductive rights and expounds the exercise methods, including compensation for tort damages, cancellation of marriage relationship and prosecution for divorce.
