论审判中心主义背景下的庭审实质化
On the Substantiation of Court Trial under the Background of Trial Centralism

随着刑事司法改革地不断深入，“审判中心主义”改革得到了学界和司法实践的广泛关注。所谓审判中心主义或以审判为中心，是指法院的审判活动是整个刑事诉讼活动的中心，其主要表现是庭审实质化。由于庭审形式化是我国刑事诉讼过程中长期存在的一个毒瘤，所以审判中心主义要求我国的庭审从原来的“庭审形式化”过渡到“庭审实质化”，如此才能“努力让人民群众在每一个司法案件中感受到公平正义”。为了实现庭审实质化的目标，本文采用历史分析法、比较分析法等方法，从转变司法理念、改革庭前制度、重构公检法关系等方面论述，以期在审判中心主义背景下实现庭审实质化的改革目标。
With the deepening of criminal justice reform, the reform of “trial centrism” has attracted extensive attention from the academic community and judicial practice. The so-called trial centralism or taking trial as the center means that the trial activities of the court are the center of the whole criminal procedure activities, and its main performance is the substantiation of the trial. Because the for-malization of court trial is a long-standing cancer in the process of criminal proceedings in China, the trial centralism requires the court trial in China to transition from the original “formalization of court trial” to “substantiation of court trial”, so as to “make the people feel fair and just in every judicial case”. In order to achieve the goal of court trial substantiation, this paper uses historical analysis, comparative analysis and other methods to discuss from the aspects of changing the judicial concept, reforming the pre-trial system, and reconstructing the relationship between the public security organ and the law, in order to achieve the reform goal of court trial substantiation under the background of trial centralism.
