小额诉讼制度的发展与反思

随着经济社会快速发展，人民的法治意识提升，对于涉及人身、财产的问题，当事人比以往更青睐选择诉讼的方式解决纠纷。使得案件受理数量激增，法院压力加大。小额诉讼程序以程序简便、审期短、成本低的特点，对民事诉讼有效地繁简分流、提升司法效率起到重要作用。我国虽然已确立了小额诉讼程序，但在司法实践中仍存在适用率低、当事人救济途径不健全等问题。最新修正的《民事诉讼法》中针对小额诉讼制度做出了改进和完善，探索制度的发展有助于我们理解习近平法治思想在民事诉讼立法领域内对让人民群众在每一个司法案件中感受到公平正义的实践践行。
With the rapid economic and social development, the people’s awareness of the rule of law to enhance, for issues involving personal and property, the parties are more favorable than ever to choose litigation to resolve disputes. This has led to a surge in the number of cases received and increased pressure on the courts. Small claims procedure with simple procedures, short trial period, low cost characteristics of civil litigation to effectively streamline, enhance judicial efficiency plays an important role. Although China has established the small claims procedure, in judicial practice there are still problems such as low application rate and unsound remedies for the parties. The newly amended Civil Procedure Law has made improvements and refinements for the small claims system, and exploring the development of the system helps us understand Jinping Xi’s rule of law ideology in the field of civil litigation legislation to make the people feel fair and just in every judicial case in practice.
