隔代探望权制度问题研究——以两个案例为视角

随着社会经济的繁荣发展，我国社会正处在一个重大的转型时期，传统的婚姻家庭关系受到猛烈冲击，离婚率不断上升。且自1982年以来，我国开始推行计划生育政策，独生子女家庭日益增多，家庭结构也随之发生改变，由外祖父母、祖父母帮助抚养外孙子女、孙子女的情形十分常见，关于隔代探望权的纠纷时常出现。一方面，当前我国法律对隔代探望没有明确规定，另一方面在当前失独家庭、独生子女、留守儿童大量存在特殊的时代背景下，探求在我国构建隔代探望权制度具有极其重要的现实意义。
With the prosperity and development of social economy, our society is in a major transition period. The traditional marriage and family relations have been severely impacted, and the divorce rate is rising. And since 1982, China has started to implement the family planning policy. The number of one-child families has increased, and the family structure has also changed. It is very common for grandparents and grandparents to help raise their grandchildren and grandchildren. Disputes about the right to visit the next generation often appear, causing widespread public concern. On the one hand, the current law of our country has no clear provisions on the right of intergenerational visit. On the other hand, in the context of the special era in which there are a large number of lost families, only children and left-behind children, it is of great practical significance to explore the establishment of the right of intergenerational visit in our country.
