服装设计作品的知识产权保护路径探索——以著作权保护为视角

Abstract:
服装设计随着时代的发展,不仅仅体现在对形式上的作用,更加体现在实质上的内容,消费者不仅关注服装设计的观感,并由服装设计所带来的物质上、心理上的愉悦。服装设计的产品是具有艺术价值的作品,能够带来巨大的利润和市场经济发展的作品,尤其是在我国人口众多的国情之下,如果对于服装设计产品的抄袭行为不加以制止,则会造成对知识产权的架空,会造成其他行业跟风模仿,由此可见,知识产权法应当更加完善,形成完成的保护链。对于目前服装设计“抄袭”实践频频发生,法律应当如何规制,本文通过对国内服装设计著作权法保护困境加以分析,找寻著作权法保护的缺点和不适应性,并对国外服装设计知识产权保护予以分析和借鉴,完善我国对服装设计作品的著作权保护。
With the development of the times, clothing design is not only reflected in the role of form, but also in the essence of content. Consumers not only pay attention to the appearance of clothing design, but also the material and psychological pleasure brought by clothing design. Clothing design products are works of artistic value that can bring huge profits and market economic development, especially under the national conditions of China with a large population. If the plagiarism of clothing design products is not stopped, it will lead to the overhead of intellectual property rights, which will lead to the imitation of other industries. It can be seen that the intellectual property law should be improved to form a complete protection chain. As for the frequent occurrence of “plagiarism” in clothing design at present, how should the law regulate it? This paper analyzes the dilemma of the protection of domestic clothing design copyright law, finds out the shortcomings and inadaptability of the protection of copyright law, and analyzes and draws lessons from the protection of foreign clothing design intellectual property rights, so as to improve the copyright protection of clothing design works in China.
