战略环境评价问题研究——以BBNJ协定为视角

Abstract:
战略环境评价要求在决策中考虑到环境保护的因素,最大程度上减少政策、计划、规划实施过程中对环境的损害,是一项重要的环境治理工具。在此之前,各国通过制定战略环境评价对各自管辖范围内的海域进行保护,取得了比较好的效果。但相比之下,国家管辖范围以外区域的战略环境评价制度的构建还是一个相对新的领域,而实际上这部分的海域占据着地球海洋的三分之二。这些地区拥有独特的生态系统,是生物多样性的重要家园。作为BBNJ协定的重要组成部分,战略环境评价在衡量累积影响,促进海洋一体化建设方面发挥了重要的作用。加强对国家管辖范围以外区域的战略环境评价研究有助于我国更好地参与全球海洋治理,维护我国的海洋权益。
Strategic environmental assessment is an important tool of environmental governance, which requires that environmental protection factors should be taken into account in the decision-making process to minimize the damage to the environment during the implementation of policies, plans and plans. Before that, countries have made strategic environmental assessment to protect the sea areas within their jurisdiction and achieved good results. But in comparison, the construction of strategic environmental assessment system for areas beyond national jurisdiction is still a relatively new field, and actually this part of the sea accounts for two thirds of the earth’s oceans. These areas have unique ecosystems and are important homes for biodiversity. As an important part of the BBNJ agreement, strategic environmental assessment plays an important role in measuring the cumulative impact and promoting the construction of marine integration. Strengthening the study on strategic environmental assessment in areas beyond the national jurisdiction will help our country to participate in global marine governance better and safeguard our maritime rights.
