Abstract:

我国新修订的《著作权法》中,以“视听作品”一词代替以往的“‘电影作品’和‘类电作品’”,进行著作权保护,是《著作权法》修改的一大亮点。但是,对于“视听作品”的定义,实践中并没有形成统一的意见。但是,随着科技的进步,大量新型视听作品出现,在视听作品的制作和保护的过程中涌现出不可忽视的问题。视听作品的“独创性”判断标准不明、范围不明确、著作权归属问题不明,这些问题均不容小觑。本文先阐明视听作品的概念、特征,对视听作品进行著作权保护的困境及难题进行梳理,再有针对性地提出具体的保护路径,意在实现对视听作品的精准定位,厘清视听作品的权属,对权利人的著作权进行更加全面的保护。
The newly revised Copyright Law replaced the previous “‘movie work’ and ‘electronic works’” with “audiovisual works” and carried out copyright protection. It is a highlight of the “Copyright Law” amendment. In practice, the definition of “audiovisual works” does not have a uniform definition. At the same time, with the advancement of technology, a large number of new audiovisual works appear. There are some problems during the production and protection of audiovisual works. The “originality” judgment standards of audiovisual works are unknown, unclear, and unknown copy-right ownership. These problems cannot be ignored. This article first clarifies the concept and characteristics of the audiovisual works, combed the dilemma and problems of copyright protection of audiovisual works, and proposes specific protection paths in a targeted manner. Perform more comprehensive protection of the copyright of the right holder.
