Definition of the Element of “Aggravating Circumstances” in Paragraph 3 of Article 17 of the Criminal Law

《刑法修正案(十一)》对未成年人刑事责任年龄进行了个别化的降低，但在条文表述中，立法机关并未对情节恶劣这一要素给予明确说明，并且犯罪情节自应用以来其范围一直处于模糊状态，为保障未成年人合法权益，综合立法目的、刑法体系、构成要件要素以及司法实践多角度权衡，情节恶劣的评价范围应当限于犯罪过程中的客观方面，其修饰范围应当包含致人死亡与致人重伤造成严重残疾两种情形。
Amendment XI to the Criminal Law lowered the age of criminal responsibility for minors individually, but the legislature did not give a clear description of the element of aggravating circumstances in the formulation of the article, and the scope of the crime has been in a vague state since its application, in order to protect the legitimate rights and interests of minors, comprehensive legislative purpose, the criminal law system, the elements of the constitutive elements and judicial practice from multiple perspectives, aggravating circumstances. In order to protect the legal rights and interests of minors, the scope of the evaluation of aggravating circumstances should be limited to the objective aspects of the crime process, and the scope of its modification should include two kinds of circumstances: causing death and causing serious injury and disability.
