夫妻非典型债务视域下日常家事代理范围认定标准

我国《民法典》规定的夫妻日常家事代理制度利于保护夫妻双方合法权益以及便利夫妻家庭生活。但是我国立法对于夫妻日常家事代理范围存在一定瑕疵，诸如《民法典》对于夫妻双方网络直播打赏、子女产生相应留学费用是否属于夫妻日常家事代理范围，其判定标准尚不明晰，会在司法实践中根据不同情况产生不同的裁判标准。我们需要结合域外立法模式以及我国学者相关学术观点提出完善建议，从而推进我国家庭生活趋向和谐以及社会交易秩序趋于稳定。
