商业场所提供网络点播服务存在两种模式，一是将视听作品上传至自建局域网服务器供公众点播，二是连接互联网供公众点播视听作品。尽管二者的观影效果并无差异，但二者所涉传播行为并不相同，前者涉及信息网络传播和放映，后者涉及信息网络传播的后续部分和放映。鉴于放映权受侵害的损失可被信息网络传播权受侵害的损失所吸收，故擅自经营前一模式侵害信息网络传播权。信息网络传播的后续部分由上传者担责，因此擅自经营后一模式侵害放映权。
There are two modes for commercial places to provide network on-demand services: one is to up-load audio-visual works to self built LAN servers for public on-demand; the other is to connect the Internet for public on-demand audiovisual works. Although there is no difference in the viewing effect between the two modes, the communication behaviors involved are different. The former involves communication through information network and projection, while the latter involves the subsequent part of communication through information network and projection. In view of the fact that the loss caused by the infringement of the right of projection can be absorbed by the loss caused by the infringement of the right of communication through information network, the unauthorized operation of the former mode infringes the right of communication through information network. The uploader is responsible for the subsequent part of communication through infor-mation network, so the unauthorized operation of the latter mode infringes on the right of projec-tion.
