遗产管理人制度是对遗产进行管理与分配的一项重要法律制度，其建立、发展和完善对我国的经济、社会的发展与稳定具有重要的社会意义。《民法典》第1147条规范了遗产管理人的职责，为其管理遗产、处理被继承人债权债务提供法律指引，文章以其职责内容为基础，通过考察司法实践，从细化遗产管理职责、构建完善职务终止规则等方面为遗产管理人履行职责提供完善建议。
The estate administrator system is an important legal system for the administration and distribution of inheritance, and its establishment, development and improvement are of great social signif-icance to the economic and social development and stability of China. Article 1147 standardizes the duties of the administrator of the estate and provides legal guidance for the management of the estate and the treatment of the creditor’s rights and debts of the decedent. Based on the content of the duties, the article examines the judicial practice and provides suggestions for improving the duties of the administrator of the estate in terms of refining the duties of the administration of the estate and constructing perfect rules for the termination of office.
