音乐著作权集体管理组织治理模式研究

我国现行音乐著作权集体管理制度的实施效果并没有达到预期。采用法定垄断治理模式的音乐著作权集体管理组织在设立方式、业务范围、授权许可模式上体现出的垄断性，造成著作权人与使用者同时抵制的结果。同时，其还受到网络音乐服务商“独家版权”模式的挑战。我国音乐著作权集体管理组织的治理模式应积极采取竞争模式，取消集体管理组织设立的门槛，允许一类作品可以设立多个有限竞争的集体管理组织；引导非专有许可方式的运用，从而规制“独家版权”模式；完善集体管理信息系统，以有效解决我国集体管理组织治理模式存在的问题。
The implementation effect of the current music copyright collective management system in my country has not reached expectations. The music copyright collective management organization that adopts the legal monopoly governance model reflects the monopoly in the way of establishment, business scope, and licensing model, resulting in the boycott of copyright owners and users at the same time. At the same time, it is also challenged by the “exclusive copyright” model of online music service providers. The governance model of my country’s music copyright collective management organizations should actively adopt a competitive model, abolish the threshold for the establishment of collective management organizations, and allow a class of works to establish multiple collective management organizations with limited competition; guide the use of non-exclusive licensing methods, thereby regulating “exclusive copyright” model; improve the collective man-agement information system to effectively solve the problems existing in my country’s collective management organization governance model.
